Updated September 2026
1. Purpose
This policy explains how Five Sense digital resources may be accessed and used by customers and members.
Five Sense provides digital educational resources, interactive activities, games, communication tools, worksheets, templates and other educational materials for schools, special schools, ARP provisions, specialist classrooms and other authorised educational settings.
The purpose of this policy is to protect the intellectual property, creative work and investment of Five Sense while allowing authorised customers and members to use the resources for their intended educational purposes.
This policy forms part of the Five Sense Terms & Conditions.
2. Ownership of Five Sense Resources
Unless expressly stated otherwise, Five Sense owns or has the appropriate rights to use and licence the materials provided through the Five Sense website and membership service.
This includes, where applicable:
Interactive games and activities
HTML, CSS, JavaScript and other software code
Educational content
Written instructions and text
Worksheets and printable resources
Templates
Graphics and illustrations
Images created by or for Five Sense
Animations
Audio and sound recordings created by or for Five Sense
Video content created by or for Five Sense
User interface designs
Layouts and visual designs
Resource structures and combinations of content
Logos, branding and other Five Sense materials
Customised resources created by Five Sense
Future resources added to the Five Sense platform
Copyright and other intellectual property rights may exist in these materials automatically under applicable law.
Nothing in a Five Sense membership transfers ownership of these rights to a customer or member.
3. Membership Provides a Licence, Not Ownership
A Five Sense membership provides the customer or member with a limited, non-exclusive, non-transferable and revocable licence to access and use Five Sense resources for authorised educational purposes.
The customer or member is purchasing access to the Five Sense service and a licence to use the available resources.
The customer or member is not purchasing the copyright, source code, ownership or intellectual property rights in those resources.
A licence allows a copyright owner to specify how another party may use their work.
4. Permitted Educational Use
Subject to the customer's or member's membership level and any specific restrictions applying to a particular resource, an authorised customer or member may:
Use Five Sense resources with pupils.
Use resources during lessons and educational activities.
Use resources on classroom computers.
Use resources on interactive whiteboards.
Use resources on tablets and compatible devices.
Use resources for individual, small-group or whole-class teaching.
Use resources with pupils who require additional or specialist educational support.
Display resources to pupils as part of normal educational provision.
Use resources at the authorised school or educational setting covered by the membership.
The purpose of the membership is to allow genuine educational use of the resources. Five Sense does not intend to prevent normal classroom use.
5. School and Setting Licence
Unless a different arrangement has been agreed in writing, a membership is intended for the school, provision or educational setting named or associated with the membership.
A customer or member must not use one membership to provide access to a separate school, organisation, business, educational setting or independent provision that is not covered by the membership.
Where an organisation operates multiple schools, sites, provisions or establishments, Five Sense may require separate memberships or may agree a different multi-site licence.
If a customer or member is unsure whether a particular use is covered by their membership, they should contact Five Sense before providing access.
6. Account and Login Security
Membership accounts and login details must be kept secure.
Customers and members must not:
Share account passwords with unauthorised individuals.
Give their account credentials to another school or organisation.
Publish login details online.
Allow non-members to use their account.
Deliberately circumvent membership access controls.
Attempt to bypass, disable or interfere with technical security measures.
Where a customer or member believes that their account details have been compromised, they should notify Five Sense as soon as reasonably possible.
Five Sense may suspend access where there is reasonable evidence of account misuse or unauthorised access.
7. Prohibited Copying and Reproduction
Unless Five Sense has given written permission, customers and members must not copy, reproduce or duplicate Five Sense resources beyond what is reasonably necessary for the permitted educational use described in this policy.
This includes, but is not limited to:
Copying complete activities.
Reproducing interactive games.
Copying source code.
Copying HTML, CSS or JavaScript.
Extracting graphics or images.
Extracting animations.
Extracting audio or music.
Copying worksheets or templates for redistribution.
Recreating resources substantially from Five Sense materials.
Duplicating the Five Sense website or activity interface.
Making downloadable copies of members-only activities where downloading is not expressly provided as part of the service.
8. Source Code and Technical Materials
Five Sense interactive resources may contain software code and technical materials that are protected by copyright and other applicable intellectual property rights.
Customers and members must not:
Extract source code for redistribution.
Copy or reuse Five Sense source code in another product.
Reverse engineer resources for the purpose of recreating or commercially exploiting them.
Remove technical protections designed to control access.
Attempt to obtain protected server-side code or functionality.
Re-host Five Sense activities independently.
Modify Five Sense code and redistribute the modified version.
Use Five Sense code as the basis for a competing educational product or service.
Normal use of an activity through a supported browser or device does not transfer ownership of the underlying software.
9. Re-uploading and Re-hosting
Customers and members must not upload, host, mirror, reproduce or make Five Sense resources available through another service or platform without written permission.
This includes:
Personal websites.
School websites.
School intranets where the resource would become independently accessible.
Google Drive or similar file-sharing services.
Microsoft OneDrive or similar services.
Public or private file-sharing platforms.
Learning management systems where a copy of the resource is being distributed.
Another educational resource website.
Another commercial platform.
A customer's or member's own web server.
Providing pupils with access to a Five Sense activity through the authorised Five Sense service is permitted.
Creating an independent copy of the activity and hosting it elsewhere is not permitted without written authorisation.
10. Sharing Activity Links
Customers and members may use Five Sense activity links for their normal authorised educational use.
However, customers and members must not deliberately share members-only activity links with:
Other schools.
Unauthorised organisations.
Non-members.
Members of the public.
Other businesses.
Individuals who are not authorised to use the membership.
Customers and members must not publicly publish members-only activity links where doing so would provide unauthorised access to Five Sense resources.
Technical access controls may be used by Five Sense to restrict access to protected resources.
11. Downloading, Screenshots, Recording and Capturing Resources
Where Five Sense expressly provides a resource as a downloadable file, that file may be used only in accordance with the licence and terms provided for that resource.
Where a resource is provided as an interactive online activity, customers and members must not intentionally capture, reproduce or distribute the activity as a substitute for the Five Sense service.
This includes, where applicable:
Recording complete activities for redistribution.
Capturing substantial portions of activities for redistribution.
Creating videos of activities for distribution outside the authorised educational setting.
Taking screenshots for the purpose of recreating or distributing the resource.
Extracting assets for use in another resource.
This does not prevent ordinary classroom use, such as displaying an activity to pupils or taking incidental photographs or recordings of a classroom where the Five Sense resource happens to appear, subject to the school's own safeguarding, privacy and data protection obligations.
12. Modification and Derivative Works
Customers and members must not modify, adapt, translate, reproduce or substantially recreate Five Sense resources for redistribution or commercial use.
This includes:
Changing Five Sense activities and distributing the modified versions.
Removing Five Sense branding and presenting the resource as another product.
Creating a substantially similar competing activity based on Five Sense source material.
Combining substantial portions of Five Sense resources with another product for redistribution.
Using Five Sense materials to create a competing commercial resource.
Customers and members may request reasonable customisations from Five Sense where this service is available.
13. AI, Automated Tools and Data Extraction
Customers and members must not use Five Sense resources, source code or substantial portions of Five Sense content as training, reference or input material for the purpose of creating a competing educational product, resource library, software application or commercial service.
Customers and members must not intentionally submit substantial Five Sense copyrighted materials to an AI system or automated content-generation service for the purpose of reproducing, recreating or commercially exploiting those materials.
This restriction does not prevent normal use of general AI tools for unrelated school activities or ordinary educational planning.
14. Commercial Use and Resale
Five Sense resources must not be:
Resold.
Rented.
Licensed to third parties.
Sublicensed.
Bundled into another commercial product.
Included in a paid resource library.
Used to create a competing subscription service.
Used to provide a paid resource service to third parties.
Given to another organisation as part of a paid service.
Used to generate revenue independently of the authorised Five Sense membership.
A Five Sense membership does not give the customer or member the right to commercially exploit Five Sense intellectual property.
15. Five Sense Branding
The Five Sense name, logo, branding, visual identity and associated materials remain the property of Five Sense or their respective rights holders.
Customers and members must not:
Remove copyright notices.
Remove Five Sense branding where it forms part of the resource.
Claim Five Sense resources as their own.
Present Five Sense resources as having been created by another organisation or individual.
Use Five Sense branding in a way that suggests an unauthorised partnership, endorsement or affiliation.
16. Custom and Personalised Resources
Where Five Sense creates a personalised or customised activity, worksheet, template, game or other resource for a customer or member, the customer or member receives permission to use that resource for the agreed educational purpose.
Unless expressly agreed otherwise in writing, creating or paying for a custom resource does not automatically transfer copyright or ownership of the underlying design, code, templates, systems or intellectual property to the customer or member.
Five Sense may retain ownership of reusable components, code, layouts, systems and underlying intellectual property used to create the customised resource.
A separate written agreement may be used where ownership or exclusive rights are intended to be transferred.
17. Third-Party Materials
Some Five Sense resources may contain or make use of materials owned or licensed by third parties.
Such materials may be subject to additional licence conditions.
Customers and members must comply with any applicable third-party licence restrictions.
Nothing in this policy grants a customer or member rights in third-party material beyond the rights Five Sense is legally able to provide.
Where appropriate, Five Sense may identify third-party materials or applicable licences.
18. Customer or Member-Supplied Content
Where customers or members upload pupil images, names or other content to a Five Sense service, the customer or member remains responsible for ensuring that they have the necessary permissions and lawful basis to provide that content.
Customers and members must not upload content that they are not authorised to use.
Customers and members should avoid providing unnecessary personal information.
Any personal data supplied to Five Sense is subject to the applicable Five Sense Privacy Policy and data protection requirements.
19. Accessibility and Educational Use
Five Sense encourages schools and educational settings to use resources flexibly to meet pupils' educational and accessibility needs.
Reasonable classroom adaptations that do not involve copying, redistributing or commercially exploiting Five Sense resources are not intended to be prohibited by this policy.
If a school or educational setting requires a significant adaptation or alternative version of a resource, Five Sense may be able to provide or create an appropriate version.
20. Technical Protection Measures
Five Sense may use technical measures to protect its resources and control access to members-only content.
These measures may include:
Account authentication.
Membership checks.
Customer membership tags.
Protected activity links.
Access gateways.
Server-side checks.
Other reasonable technical security measures.
Customers and members must not attempt to bypass, disable, interfere with or circumvent these measures.
Attempting to bypass technical access controls may constitute a breach of this policy and the customer's or member's membership agreement.
21. Membership Expiry or Termination
When a membership expires or is terminated, the customer or member's licence to access members-only Five Sense resources ends, except where a specific written agreement provides otherwise.
Customers and members must not:
Continue accessing members-only resources without authorisation.
Re-upload previously accessed resources.
Continue distributing Five Sense resources.
Give former staff or third parties continued access.
Use copied resources as a replacement for an active membership.
Where a resource was legitimately downloaded under an express download licence, the customer or member must continue to comply with the terms applicable to that download.
22. Breach of This Policy
If Five Sense has reasonable grounds to believe that a customer or member has materially breached this policy, Five Sense may take appropriate action.
Depending on the circumstances, this may include:
Contacting the customer or member and requesting that the activity stops.
Requesting removal of unauthorised copies.
Requesting deletion of unauthorised copies.
Restricting or suspending account access.
Terminating a membership in accordance with the applicable Terms & Conditions.
Requiring unauthorised recipients to cease using the resources.
Seeking an appropriate licence or settlement where applicable.
Taking further legal action where appropriate.
Any action taken will depend on the nature and seriousness of the suspected breach.
23. Unauthorised Use by Third Parties
If a customer or member discovers that Five Sense resources have been copied, distributed, re-hosted or otherwise used without permission, they are encouraged to notify Five Sense.
Reports should be sent to:
Where possible, include:
The name of the person or organisation involved.
The relevant website or platform.
The affected Five Sense resource.
Screenshots or other evidence.
The date the unauthorised use was identified.
24. Enforcement of Intellectual Property Rights
Five Sense reserves all rights available to it in respect of unauthorised use of its intellectual property.
Copyright infringement can include unauthorised copying, distribution, adaptation or putting protected material online where no applicable permission or exception applies.
Five Sense may first seek to resolve an issue directly with the person or organisation involved. Where appropriate, this may include requesting removal of the material or negotiating an appropriate licence.
If an infringement cannot be resolved, Five Sense may consider mediation, professional legal advice or legal proceedings where appropriate.
25. No Waiver of Rights
If Five Sense does not immediately take action in response to a breach of this policy, this does not mean that Five Sense has waived its rights or given permission for the conduct to continue.
Five Sense may enforce its rights in relation to future or continuing breaches.
26. Exceptions Required by Law
Nothing in this policy is intended to prevent a customer or member from exercising a right or exception that cannot lawfully be excluded by contract.
Copyright law contains specific exceptions in certain circumstances, including certain educational and accessibility-related uses. Whether a particular exception applies depends on the circumstances.
Nothing in this policy should be interpreted as attempting to remove a statutory right that cannot legally be removed.
27. Intellectual Property Notices
Five Sense may include copyright or other intellectual property notices within its website, activities, files and resources.
A copyright notice may include:
© 2026 Five Sense. All rights reserved.
The absence of a copyright notice does not mean that a work is free to copy. Copyright protection generally arises automatically where the legal requirements are met.
28. Ownership of Improvements and Feedback
Customers and members may provide suggestions, feedback or ideas regarding Five Sense resources.
Feedback may be used by Five Sense to improve its products and services.
Where feedback results in an improvement to an existing Five Sense resource, the resulting resource and associated intellectual property remain subject to the applicable ownership and licensing arrangements.
This does not give Five Sense ownership of a customer's or member's independent intellectual property merely because they provided feedback.
29. Changes to This Policy
Five Sense may update this policy from time to time to reflect changes to its services, resources, technology or applicable legal requirements.
The current version published by Five Sense will apply from its stated effective date.
Where a change materially affects existing customers' or members' contractual rights or obligations, Five Sense will provide any notice required under the applicable Terms & Conditions or law.
